Criminal Cases Review Commission

Our lawyers have experience in taking cases to the Criminal Cases Review Commission (CCRC).


The CCRC is an independent statutory body created by s.8 of the Criminal Appeal Act 1995. The CCRC has the responsibility for investigating miscarriages of justice throughout England, Wales and Northern Ireland. They are independent from the police, courts and government and have the powers to obtain case papers and disclosure documents from various sources and investigative bodies when reviewing cases put before them. Failure to not provide disclosure to the CCRC upon request is an offence and therefore, compliance by the CPS and the police to disclosure documents to the CCRC is not optional.


Cases are often referred to the CCRC when processes of appeal have been exhausted, but there is a possibility that the conviction or sentence received has been unjust. The CCRC is the only service that has the power to send cases back to the Court of Appeal, and can exercise special legal powers when investigating any potential judicial errors.


The CCRC is perhaps best thought of as a "safety net" when an appeal has not succeeded, but there has been a clear error in the justice process.
