When Will I Attend Court?
If you have been charged with a sexual offence, or offence arising from domestic abuse allegations then you will be required to attend court.
Our team will always aim to be the ones to inform you of any charging decision. However, you may be required to attend the police station to receive your charges in person or they may be sent in the post by way of a postal requisition. The court hearing will take place some 4-6 weeks later.
Going to court is not what any of us plan for and can lead to many difficulties including, physical, emotional and mental health problems for the defendant. We encourage our clients to allow us and trust us to take care of the legal aspects of their case, enabling them to take care of themselves.
Formally being charged is the first step in your case proceeding through the court process. When someone is charged with a criminal offence, they must go to court to answer to that charge by firstly entering their plea at their first appearance. The main criminal courts in the UK are:
There are three types of criminal offences; summary only, indictable only and either-way offences. Summary only offences are those which can only be tried in the Magistrates Court, these cases remain in the Magistrates Court.
Indictable only offences can only be heard by the Crown Court. Sexual offences which are indictable only include rape, and sexual assault by penetration.
Either-way offences can be heard by either the Magistrates Court or the Crown Court. It may in some instances be left up to the defendant charged with an either-way offence to decide where they want their case to be heard and your lawyer will advise you on the best options for your case.
