Legal Definition Of Rape
Rape is a serious offence contrary to section 1 of the Sexual Offences Act 2003, a person has committed the offence if they penetrate the vagina, anus or mouth of another, with their penis, without the consent of the other party, and they did not reasonably believe that the person was consenting.
Rape is an indictable offence only which means it can only be heard in the Crown Court and carries a maximum sentence of life imprisonment.
Legal Definition Of Assault By Penetration
Contrary to section 2 of the Sexual Offences Act 2003, sexual assault by Penetration also carries a maximum sentence of life imprisonment. This offence is similar to rape and is complete where a person has sexually penetrated the vagina, anus or mouth of another with a part of their body or anything else. The penetration was not consensual, and there was no reasonable belief that it was.
Legal Definition Of Sexual Assault
Sexual Assault is a less severe offence than those mentioned above. However, it can carry a lengthy custodial sentence if convicted. Contrary to section 3 of the Sexual Offences Act 2003, a sexual assault takes place when a person has touched another person sexually, and there was no consent to the touching.

Our dedicated legal team provides expert legal representation and defence for rape, sexual assault, and other sexual offences across the UK.
If you are facing allegations of sexual misconduct, it is crucial to obtain legal advice as early as possible to protect your rights and build a strong defence. Building your defence as early as possible ensures that all available evidence for you is secured, and you are guided on how to navigate the process to your advantage.
We have extensive experience handling complex cases, and our lawyers are not afraid to challenge the police or Crown Prosecution Service in order to protect our client’s position.
With our specialist knowledge and proactive approach, we are committed to defending your case professionally and carefully, safeguarding you is our priority.
Being accused of rape or sexual assault can be a highly distressing and life-altering experience. The process typically begins with a police investigation, during which you may be arrested, interviewed under caution, and possibly placed on bail or released under investigation whilst the police conduct further enquiries.
It is essential to obtain legal advice as early as possible to protect your rights and build a strong defence. The police will gather evidence, including witness statements, forensic reports, and digital records, before referring the case to the Crown Prosecution Service (CPS), who are responsible for assessing the evidence and deciding whether to charge you with an offence, if so what offence.
If charged, you will face court proceedings, where having experienced rape defence lawyers is essential. We hope by this stage to have built a working relationship with our client and understand their position so the strongest defence possible can be presented.
Given the serious consequences of a conviction, including potential imprisonment, Sexual Harm Prevention Orders, being made subject to the notification requirements of the Sex Offenders Register, and the impact on your family and career, early intervention from specialist legal experts can make a significant difference in the outcome of your case.
In the first 24 hours of being arrested with rape or sexual assault, you will likely be taken into police custody either under arrest or attending a police interview as a volunteer. During this time, you will be interviewed, where the allegations will be put to you for a response. It is your right to remain silent during a police interview, but obtaining legal advice prior to making this decision is important.
Following your interview, you are likely to be on bail with conditions, whilst further enquiries are made. A decision will then be made whether or not your case is to be sent to the CPS for a charging decision, there are various avenues the police must go through prior to this, and our pre-charge engagements provides us with the opportunity to be involved in this process, on your behalf.
Bail conditions can impact your ability to live at home, work, and have contact with children. The police can also apply for court orders without the need for a conviction, such as a Sexual Risk Order. Therefore, obtaining specialist legal advice in respect of sexual assault allegations, whilst your case is being investigated is strongly advised, to ensure you are not unnecessarily restricted when facing what can be a lengthy and difficult process.
If you are remanded into custody, you will be taken to a magistrates' court as soon as possible, where the decision on bail will be made by the court. This outcome is reserved for the most serious allegations, where police feel you may be a danger to the public, a specific member of the public or group of the public.
Given the severity of sexual offence allegations, early legal intervention can significantly impact the direction of your case and increase your chances of a successful defence.
